Terms of Submission & Copyright Policy

Effective Date: October 16, 2025

1. Applicability & Assent

These Terms of Submission (“Terms”) apply whenever you provide event details, text, images, or other materials (“Submitted Content”) to SF Art Guide, including but not limited to:

  • through our online event submission form,
  • by email in response to an open call or invitation from SF Art Guide, or
  • via any other submission method we designate (for example, a shared upload link or campaign hashtag).

By clicking Submit on our online form—or by otherwise sending materials to us after receiving or having reasonable access to these Terms—you confirm that you have read, understood, and agree to these Terms of Submission.

2. Ownership & Permission

You represent and warrant that you either own all rights in the Submitted Content or have obtained written permission from the copyright owner(s) to share the materials with SF Art Guide. You also confirm that any identifiable individuals or property shown in photographs have granted appropriate model or property release permissions for promotional use.

3. License Grant

You grant SF Art Guide, its affiliates, and successors an irrevocable, perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, publish, distribute, edit, adapt, and publicly display the Submitted Content, in whole or in part, in any media now known or later developed. This includes, without limitation, digital and print promotion, editorial coverage, and archival or informational uses related to SF Art Guide and Bay Area arts coverage.

4. Editorial Rights & Moral Rights Notice

SF Art Guide may edit, crop, resize, or adjust Submitted Content for clarity, length, or formatting, consistent with its publication standards. Such editorial or formatting changes do not constitute a distortion or modification under the California Art Preservation Act (Cal. Civ. Code §§ 987–989) or any other law protecting moral rights.

5. Removal and Takedown

SF Art Guide reserves the right to remove, decline to publish, or edit any submission at its discretion. SF Art Guide also complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) and will remove or disable access to materials upon receipt of a valid copyright complaint, as outlined below.

6. Indemnification

You agree to indemnify, defend, and hold harmless SF Art Guide, its owners, affiliates, and employees from any claims, damages, or liabilities (including reasonable attorney’s fees) arising out of or related to:

  • your Submitted Content,
  • any alleged infringement or violation of rights, or
    your breach of these Terms.

7. Dispute Resolution

Any dispute arising from these Terms shall first be subject to good-faith mediation in San Francisco, California, followed—if not resolved—by binding arbitration under California law. Each party will bear its own legal fees unless otherwise required by statute. SF Art Guide may seek injunctive relief in court to prevent misuse of its intellectual property.

8. DMCA Takedown Notice

SF Art Guide respects the intellectual property rights of artists, photographers, and all creators. If you believe that any material published by SF Art Guide infringes your copyright, please submit a DMCA Takedown Notice containing the following:

  1. Identification of the copyrighted work claimed to have been infringed.
  2. Identification of the allegedly infringing material and its location on the SF Art Guide website or social media.
Your full name, mailing address, telephone number, and valid email address.
  3. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  4. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
  5. Your physical or electronic signature.

Submit notices to: legal@sfartguide.com

SF Art Guide will promptly remove or disable access to the material in question upon receiving a valid notice and may notify the submitter of the claim.

9. General Terms

These Terms constitute the entire agreement regarding Submitted Content and supersede any prior communications. SF Art Guide may update these Terms from time to time; continued use of our submission channels after notice of change constitutes acceptance of the revised Terms.
